“Forced transfers and deportation of Ukrainian children -security measures or a war crime?”, Veronika Bílkova (IIR, Czech Republic)

On May 4, 2023, the Organization for Security and Cooperation in Europe (OSCE) published the third report of the expert mission to Ukraine issued within the framework of the so-called Moscow Mechanism. The report focuses on forced transfers and deportations of Ukrainian children to territories under Russian control, or directly to Russia. It confirms that the practice in question is indeed taking place and states that this practice involves numerous and repeated violations of international humanitarian law and international human rights law and appears to fulfill the characteristics of a war crime and a crime against humanity. The reflection first presents the so-called Moscow mechanism and then offers a summary of the main factual and legal conclusions of the report. He is also thinking about the possible influence of the report on the proceedings before the International Criminal Court (ICC).
